       AN  ACT to amend the general business law, in relation to candy and food
         products packaged as tobacco products
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The general business law is amended by adding a new section
    2  399-j to read as follows:
    3    S  399-J.  CANDY AND FOOD PRODUCTS PACKAGED AS TOBACCO PRODUCTS. 1. NO
    4  CANDY, CONFECTION OR OTHER FOOD PRODUCT SHALL BE  SOLD  OR  OFFERED  FOR
    5  SALE  AT  RETAIL  IN  THIS  STATE  WHICH  SHALL BE PACKAGED OR SHAPED TO
    6  EMULATE OR RESEMBLE ANY TYPE OF  TOBACCO  PRODUCTS  INCLUDING,  BUT  NOT
    7  LIMITED TO, CIGARETTES, CIGARS OR POWDERED TOBACCO.
    8    2.  A  VIOLATION  OF THE PROVISIONS OF THIS SECTION SHALL CONSTITUTE A
    9  VIOLATION AS DEFINED IN THE PENAL LAW.
   10    S 2. This act shall take effect on the first of November next succeed-
   11  ing the date on which it shall have become a law.
