STATE OF NEW YORK ________________________________________________________________________ 4469 2021-2022 Regular Sessions IN ASSEMBLY February 4, 2021 ___________ Introduced by M. of A. WALKER, COLTON, COOK, SEAWRIGHT -- read once and referred to the Committee on Codes AN ACT to amend the penal law, in relation to harassing certain employ- ees of a transit agency or authority The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 240.30 of the penal law is amended by adding a new 2 subdivision 3-a to read as follows: 3 3-a. Strikes, shoves, kicks, or otherwise subjects another person to 4 physical contact, which includes spitting on such other person, and such 5 other person is a train operator, ticket inspector, conductor, signal- 6 person, bus operator or station agent employed by any transit agency, 7 authority or company, public or private, whose operation is authorized 8 by New York state or any of its political subdivisions; or 9 § 2. This act shall take effect on the ninetieth day after it shall 10 have become a law. EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted.
