       AN  ACT to amend the vehicle and traffic law and the administrative code
         of the city of New York, in relation to alternate side of  the  street
         parking
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The vehicle and traffic law is  amended  by  adding  a  new
    2  section 1205 to read as follows:
    3    S  1205. ALTERNATE SIDE OF THE STREET PARKING. WHEN PARKING IS PROHIB-
    4  ITED BY THIS ARTICLE OR BY LOCAL LAW, ORDINANCE, ORDER,  RULE  OR  REGU-
    5  LATION,  PURSUANT  TO AN ALTERNATE SIDE OF THE STREET PARKING LAW, ORDI-
    6  NANCE, ORDER, RULE OR REGULATION, NO PENALTY SHALL BE IMPOSED, NOR SHALL
    7  ANY NOTICE OF VIOLATION BE ISSUED TO AN OWNER OR OPERATOR OF  A  VEHICLE
    8  UNLESS  AND  UNTIL  TEN  MINUTES  HAVE ELAPSED FROM THE TIME POSTED ON A
    9  TRAFFIC SIGN, SIGNAL OR MARKING THAT DEMARCATES THE PROHIBITED PERIOD OF
   10  PARKING. THE ELAPSED TIME SHALL BE MEASURED FROM THE TIME  POSTED  ON  A
   11  TRAFFIC SIGN, SIGNAL OR MARKING THAT DEMARCATES THE PROHIBITED PERIOD OF
   12  PARKING TO THE TIME PUBLISHED ON THE NOTICE OF VIOLATION, WITH THE PERI-
   13  OD UP TO AND INCLUDING TEN MINUTES PAST THE POSTED PROHIBITED PERIOD NOT
   14  CONSTITUTING A VIOLATION OF THE PROHIBITIONS POSTED ON THE TRAFFIC SIGN,
   15  SIGNAL OR MARKING.
   16    S 2. Subdivision (b) of section 1640 of the vehicle and traffic law is
   17  amended to read as follows:
   18    (b)  Such  a legislative body also may by local law, ordinance, order,
   19  rule or regulation prohibit, restrict or limit the stopping, standing or
   20  parking of vehicles upon property  owned  or  leased  by  such  city  or
   21  village;  PROVIDED  THAT  SUCH  LAWS, ORDINANCES, ORDERS, RULES OR REGU-
   22  LATIONS DO NOT CONFLICT WITH ARTICLE THIRTY-TWO OF THIS CHAPTER.

    1    S 3. Subdivision (d) of section 1660 of the vehicle and  traffic  law,
    2  as  added  by  chapter  763  of  the laws of 1964, is amended to read as
    3  follows:
    4    (d) Such a town board also may by ordinance, order, rule or regulation
    5  prohibit,  restrict  or limit the stopping, standing or parking of vehi-
    6  cles upon property owned or leased by  such  town;  PROVIDED  THAT  SUCH
    7  ORDINANCES,  ORDERS,  RULES  OR REGULATIONS DO NOT CONFLICT WITH ARTICLE
    8  THIRTY-TWO OF THIS CHAPTER.
    9    S 4. The administrative code of the city of New  York  is  amended  by
   10  adding a new section 19-163.2 to read as follows:
   11    S  19-163.2 GRACE PERIOD FOR PARKING RULES. WHEN PARKING IS PROHIBITED
   12  BY THIS ARTICLE OR BY LOCAL LAW, ORDINANCE, ORDER, RULE  OR  REGULATION,
   13  PURSUANT  TO  AN  ALTERNATE  SIDE  OF THE STREET PARKING LAW, ORDINANCE,
   14  ORDER, RULE OR REGULATION, NO PENALTY SHALL BE IMPOSED,  NOR  SHALL  ANY
   15  NOTICE  OF  VIOLATION  BE  ISSUED  TO  AN OWNER OR OPERATOR OF A VEHICLE
   16  UNLESS AND UNTIL TEN MINUTES HAVE ELAPSED FROM  THE  TIME  POSTED  ON  A
   17  TRAFFIC SIGN, SIGNAL OR MARKING THAT DEMARCATES THE PROHIBITED PERIOD OF
   18  PARKING.  THE  ELAPSED  TIME SHALL BE MEASURED FROM THE TIME POSTED ON A
   19  TRAFFIC SIGN, SIGNAL OR MARKING THAT DEMARCATES THE PROHIBITED PERIOD OF
   20  PARKING TO THE TIME PUBLISHED ON THE NOTICE OF VIOLATION, WITH THE PERI-
   21  OD UP TO AND INCLUDING TEN MINUTES PAST THE POSTED PROHIBITED PERIOD NOT
   22  CONSTITUTING A VIOLATION OF THE PROHIBITIONS POSTED ON THE TRAFFIC SIGN,
   23  SIGNAL OR MARKING.
   24    S 5. This act shall take effect immediately.
