STATE OF NEW YORK ________________________________________________________________________ 4705 2019-2020 Regular Sessions IN ASSEMBLY February 5, 2019 ___________ Introduced by M. of A. ENGLEBRIGHT -- read once and referred to the Committee on Higher Education AN ACT to amend the education law, in relation to prohibiting the direct merchandising of credit cards through the state university of New York and the city university of New York The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The education law is amended by adding a new section 355-d 2 to read as follows: 3 § 355-d. Direct merchandising of credit cards; prohibitions. 1. When 4 used in this section, the term "direct merchandising" means the 5 promotion to sell or offer any goods, wares or merchandise to any person 6 by means of interpersonal contact or through the use of displays. 7 2. The state university is not authorized to enter into any agreement 8 for the direct merchandising of credit cards through the state universi- 9 ty of New York to any enrolled student thereof. 10 3. The provisions of this section shall apply to any person, partner- 11 ship, firm, association, limited liability company or corporation acting 12 as an agent or employee or on behalf of such university for the purposes 13 of the direct merchandising of credit cards. 14 § 2. The education law is amended by adding a new section 6204-b to 15 read as follows: 16 § 6204-b. Direct merchandising of credit cards; prohibitions. 1. When 17 used in this section, the term "direct merchandising" means the 18 promotion to sell or offer any goods, wares or merchandise to any person 19 by means of interpersonal contact or through the use of displays. 20 2. The city university is not authorized to enter into any agreement 21 for the direct merchandising of credit cards through the city university 22 of New York to any enrolled student thereof. 23 3. The provisions of this section shall apply to any person, partner- 24 ship, firm, association, limited liability company or corporation acting EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted.
