        AN ACT to amend the education law and the public health law, in relation
          to  requiring  the  commissioner  of education to establish standards,
          rules or regulations requiring that all chaperones  or  volunteers  of
          school  trips which involve taking students out of the state or out of
          the country be trained in first aid and to recognize  certain  medical
          emergencies

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Section 305 of the education law is amended by adding a new
     2  subdivision 60 to read as follows:
     3    60. The  commissioner,  in  collaboration  with  the  commissioner  of
     4  health, shall promulgate such standards, rules and regulations as may be
     5  necessary  to ensure that students who are on an out of the state or out
     6  of the country school sanctioned activity or trip shall  be  accompanied
     7  by  at least one person who is trained in first aid and to recognize and
     8  respond to certain medical emergencies at all times while  the  students
     9  are  out  of  the state or out of the country. Such standards, rules and
    10  regulations shall provide that chaperones and volunteers of  any  school
    11  sanctioned  activity  or trip which conveys students out of the state or
    12  out of the country shall be trained in first aid and  to  recognize  and
    13  respond  to  certain  medical  emergencies.   The commissioner of health
    14  shall assist the commissioner in  determining  the  medical  emergencies
    15  chaperones  and volunteers shall be trained to recognize and respond to.
    16  For the purposes of this subdivision, the terms "chaperone" and  "volun-
    17  teer"  shall mean any adult who accompanies students on an excursion out
    18  of the state or out of the country, regardless of whether such adult  is
    19  employed by the school district.

     1    §  2.  Section 206 of the public health law is amended by adding a new
     2  subdivision 31 to read as follows:
     3    31. The commissioner of health shall assist the commissioner of educa-
     4  tion  in  promulgating  standards,  rules,  and  regulations relating to
     5  requiring chaperones and volunteers of school sanctioned  activities  or
     6  trips which convey students out of the state or out of the country to be
     7  trained  in first aid and determining the medical emergencies chaperones
     8  and volunteers shall be trained to recognize and respond to when  accom-
     9  panying students on such trips or activities.
    10    § 3. This act shall take effect immediately.
