       AN  ACT to amend the public health law, in relation to requiring general
         hospitals to offer information  about  an  anti-viral  prophylaxis  to
         high-risk infants for the prevention of respiratory syncytial virus
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The public health law is amended by adding  a  new  section
    2  2805-w to read as follows:
    3    S  2805-W.  PREVENTION  OF  RESPIRATORY  SYNCYTIAL  VIRUS IN PREMATURE
    4  INFANTS. IT SHALL BE THE DUTY OF THE  ADMINISTRATIVE  OFFICER  OR  OTHER
    5  DESIGNATED  PERSON  AT  EACH  FACILITY LICENSED PURSUANT TO THIS ARTICLE
    6  CARING FOR NEWBORN INFANTS TO OFFER TO THE PERSON IN  PARENTAL  RELATION
    7  TO  A  PREMATURE  INFANT  OR  CHILD UNDER THE AGE OF TWO AND AT RISK FOR
    8  RESPIRATORY SYNCYTIAL VIRUS U.S. FOOD AND DRUG  ADMINISTRATION  INFORMA-
    9  TION  ABOUT  APPROVED  MEDICATION  FOR  THE  PROPHYLAXIS FOR RESPIRATORY
   10  SYNCYTIAL VIRUS (RSV) FOR SAID INFANT OR CHILD.
   11    S 2. This act shall take effect immediately.
