       AN ACT to amend the insurance law, in relation to prohibiting disclosure
         of a claim for surgical procedure to  the  employer  by  an  insurance
         carrier
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The insurance law is amended by adding a new  section  3114
    2  to read as follows:
    3    S 3114. PROHIBITION OF DISCLOSURE OF A SURGICAL PROCEDURE UNDER INSUR-
    4  ANCE  POLICIES. NO INSURER LICENSED UNDER THIS CHAPTER OR HEALTH MAINTE-
    5  NANCE ORGANIZATION CERTIFIED UNDER  ARTICLE  FORTY-FOUR  OF  THE  PUBLIC
    6  HEALTH  LAW  SHALL DISCLOSE TO THE EMPLOYER OF A COVERED PERSON THE FACT
    7  THAT A CLAIM FOR A SURGICAL  PROCEDURE  HAS  BEEN  SUBMITTED  UNDER  THE
    8  PROVISIONS  OF  AN INSURANCE POLICY OR CONTRACT BETWEEN A HEALTH MAINTE-
    9  NANCE ORGANIZATION AND AN ENROLLEE.
   10    S 2. This act shall take effect on the ninetieth day  after  it  shall
   11  have  become  a  law.  Effective  immediately  any rules and regulations
   12  necessary for the timely implementation of this  act  on  its  effective
   13  date shall be promulgated on or before such date.
