STATE OF NEW YORK ________________________________________________________________________ 5083 2017-2018 Regular Sessions IN ASSEMBLY February 6, 2017 ___________ Introduced by M. of A. ROSENTHAL, CRESPO, DAVILA, BARRON -- read once and referred to the Committee on Alcoholism and Drug Abuse AN ACT to amend the mental hygiene law, in relation to commissioning a statewide evaluation regarding the extent of gambling by New York state residents The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 19.09 of the mental hygiene law is amended by 2 adding a new subdivision (k) to read as follows: 3 (k) The commissioner, in consultation with the New York state gaming 4 commission, is authorized and directed to commission a statewide evalu- 5 ation regarding the extent of gambling by New York state residents, 6 including, but not limited to the lottery, horse racing, Native American 7 casinos, internet gambling, sports betting, and poker. Such evaluation 8 shall be delivered to the governor and legislature no later than Decem- 9 ber first, two thousand twenty-one. The evaluation shall be prepared by 10 an independent entity and selected through a request for proposal proc- 11 ess. Such evaluation shall include: 12 (1) the percentage of New York residents participating in each gambl- 13 ing activity by: 14 (a) age; 15 (b) race; 16 (c) income; 17 (d) education; 18 (e) sex; and 19 (f) any other demographic that would be relevant to the evaluation; 20 and 21 (2) an estimate of the amount of money being wagered and lost by New 22 York residents in each gambling activity. 23 § 2.
