STATE OF NEW YORK ________________________________________________________________________ 5123 2021-2022 Regular Sessions IN ASSEMBLY February 11, 2021 ___________ Introduced by M. of A. BENEDETTO -- read once and referred to the Committee on Alcoholism and Drug Abuse AN ACT to amend the mental hygiene law, in relation to prohibiting the approval of licenses for alcoholism programs, substance abuse programs, and chemical dependence programs within five hundred feet of a school, public park, or church, synagogue, or other place of worship The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision (a) of section 19.21 of the mental hygiene law, 2 as added by chapter 223 of the laws of 1992, is amended to read as 3 follows: 4 (a) The office shall inspect and approve or disapprove the facilities 5 of and the services provided by alcoholism programs, substance abuse 6 programs, and chemical dependence programs, and any program or facility 7 purporting to provide such services. The office shall not approve any 8 facility of or services provided by any alcoholism program, substance 9 abuse program, or chemical dependence program, or any program or facili- 10 ty purporting to provide such services where such facility is, or where 11 the location of such services are, located within five hundred feet of a 12 school, public park, or church, synagogue, or other place of worship. 13 § 2.
