        AN ACT to amend the penal law, in relation  to  assault  in  the  second
          degree

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Section 120.05 of the penal law is amended by adding a  new
     2  subdivision 15 to read as follows:
     3    15. With the intent to cause physical injury to a person employed as a
     4  motor  vehicle  license  examiner  by  the  department of motor vehicles
     5  performing his or her lawful duties or in relation to his or her  lawful
     6  duties, he or she causes physical injury to such employee.
     7    § 2. This act shall take effect on the first of November next succeed-
     8  ing the date on which it shall have become a law.
