CLARK -- read once and referred to the Committee on Codes AN ACT to amend the penal law, in relation to providing that aggravated harassment in the second degree of a judge is a class E felony THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The closing paragraph of section 240.30 of the penal law, 2 as amended by chapter 510 of the laws of 2008, is amended to read as 3 follows: 4 Aggravated harassment in the second degree is a class A misdemeanor; 5 PROVIDED, HOWEVER, THAT IF THE VICTIM OF SUCH HARASSMENT IS A JUDGE THEN 6 SUCH AGGRAVATED HARASSMENT IN THE SECOND DEGREE IS A CLASS E FELONY. 7 S 2.
