STATE OF NEW YORK ________________________________________________________________________ 5697 2017-2018 Regular Sessions IN ASSEMBLY February 14, 2017 ___________ Introduced by M. of A. BARCLAY -- read once and referred to the Commit- tee on Local Governments AN ACT to amend the town law and the public officers law, in relation to waiving the residency requirement for the town justice in the town of Boylston, in Oswego county The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 23 of the town law is amended by adding a new 2 subdivision 31 to read as follows: 3 31. Notwithstanding subdivision one of this section, in the town of 4 Boylston, Oswego county, the person performing the function of town 5 justice need not be an elector of such town. Provided, however, the 6 person performing the function of town justice in any other town shall 7 be an elector of such town, unless otherwise provided by an act of the 8 state legislature. 9 § 2. Section 3 of the public officers law is amended by adding a new 10 subdivision 66 to read as follows: 11 66. In the town of Boylston, Oswego county, the provisions of this 12 section requiring a person to be a resident of the political subdivision 13 or municipal corporation of the state for which he or she shall be 14 chosen, or within which his or her official function is required to be 15 exercised, shall not prevent a person from holding the office of town 16 justice of the town of Boylston; provided that said person resides in a 17 town which adjoins such town and which is in the county of Oswego. 18 Provided, however, the person performing the functions of town justice 19 in any other town shall be a resident of such town, unless otherwise 20 provided by law. 21 § 3.
