STATE OF NEW YORK ________________________________________________________________________ 5800 2017-2018 Regular Sessions IN ASSEMBLY February 15, 2017 ___________ Introduced by M. of A. NOLAN -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to directing the commis- sioner of education to establish rules and regulations for a sepsis awareness and prevention program for school districts, boards of coop- erative educational services and nonpublic schools The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Short title. This act shall be known and may be cited as 2 "Rory Staunton's law". 3 § 2. Section 305 of the education law is amended by adding a new 4 subdivision 56 to read as follows: 5 56. a. The commissioner shall promulgate and review as necessary, 6 rules and regulations relating to an ongoing sepsis awareness, 7 prevention and education program. In developing such rules and regu- 8 lations, the commissioner shall consider comments from stakeholders and 9 other interested parties including but not limited to parents, teachers, 10 students, school administrators, medical and health professionals and 11 sepsis awareness and prevention groups. Such regulations shall include, 12 but not be limited to: 13 (i) requiring a model curriculum, lesson plans, and instructional 14 resources relating to a sepsis awareness and prevention program designed 15 to promote awareness and prevention methods against sepsis to be made 16 available at no cost for every school district. Such model curriculum, 17 lesson plans and instructional resources shall include but not be limit- 18 ed to guidelines and methods of prevention, including recommendations 19 for the reduction of exposure to sepsis and appropriate course of action 20 for sepsis; 21 (ii) instructional tools and materials for schools and libraries 22 developed in collaboration with the commissioner of health to ensure 23 such tools and materials include updated data and information on sepsis EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD09716-01-7A. 5800 2 1 awareness and prevention, with a periodic review to ensure up-to-date 2 information; and 3 (iii) providing that the department shall post on its internet website 4 information relating to sepsis awareness and prevention, which shall 5 include but not be limited to, the definition of "sepsis", risks associ- 6 ated with sepsis, signs and symptoms of sepsis, how sepsis may occur, 7 and the methods of prevention of sepsis. Schools shall be required to 8 include such information or reference how to obtain such information 9 from the department's internet website on the school's internet website, 10 if one exists. 11 b. The commissioner shall issue a guidance memorandum to every school 12 district to inform them of the availability of sepsis awareness and 13 prevention model curriculum, lesson plans and best practice instruc- 14 tional material and annually, in September, the commissioner shall 15 remind districts of the availability of sepsis awareness and prevention 16 materials as a part of sepsis awareness month. 17 § 3. This act shall take effect on the first of July next succeeding 18 the date on which it shall have become a law; provided, however, that 19 effective immediately, the addition, amendment and/or repeal of any rule 20 or regulation necessary for the implementation of this act on its effec- 21 tive date is authorized to be made completed on or before such effective 22 date.
