STATE OF NEW YORK ________________________________________________________________________ 6218 2017-2018 Regular Sessions IN ASSEMBLY February 28, 2017 ___________ Introduced by M. of A. McDONALD, SCHIMMINGER -- read once and referred to the Committee on Labor AN ACT to amend the workers' compensation law, in relation to payment of compensation to employees who suffer permanent partial disability The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The opening paragraph of subdivision 3 of section 15 of the 2 workers' compensation law is amended to read as follows: 3 In case of disability partial in character but permanent in quality, 4 for which the impairment of wage earning capacity is found to be under 5 eighty-five percent, the compensation shall be sixty-six and two-thirds 6 per centum of the average weekly wages and shall be paid to the employee 7 during the continuance of such permanent partial disability, but shall 8 not exceed five hundred twenty-five weeks from the date of the injury. 9 In case of disability partial in character but permanent in quality, for 10 which the impairment of wage earning capacity if found to be eighty-five 11 percent or more, the compensation shall be sixty-six and two-thirds 12 percent of the average weekly wages and shall be paid to the employee 13 for the period named in this subdivision, as follows: 14 § 2. This act shall take effect on the first of January next succeed- 15 ing the date on which it shall have become a law.
