DiPIETRO, GIGLIO, McLAUGHLIN, PERRY, ROZIC, SIMOTAS, SOLAGES -- read once and referred to the Committee on Insurance AN ACT to amend the insurance law, in relation to mandatory health insurance coverage for tracking devices for children with develop- mental disabilities The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subsection (i) of section 3216 of the insurance law is 2 amended by adding a new paragraph 34 to read as follows: 3 (34) Every policy which provides medical, major medical, or similar 4 comprehensive type coverage shall include coverage for GPS tracking 5 devices to be used on children with developmental disabilities, provided 6 that the treating physician or other licensed health care provider 7 issues a written order stating such device is necessary for the child's 8 welfare. 9 § 2. Subsection (l) of section 3221 of the insurance law is amended by 10 adding a new paragraph 20 to read as follows: 11 (20) Every policy which provides medical, major medical, or similar 12 comprehensive type coverage shall include coverage for GPS tracking 13 devices to be used on children with developmental disabilities, provided 14 that the treating physician or other licensed health care provider 15 issues a written order stating such device is necessary for the child's 16 welfare. 17 § 3. Section 4303 of the insurance law is amended by adding a new 18 subsection (rr) to read as follows: 19 (rr) Every policy which provides medical, major medical, or similar 20 comprehensive type coverage shall include coverage for GPS tracking 21 devices to be used on children with developmental disabilities, provided 22 that the treating physician or other licensed health care provider EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. This act shall take effect on the ninetieth day after it shall 4 have become a law and shall apply to policies and contracts issued, 5 renewed, modified, altered or amended on or after such effective date.
