BOYLAND, COLTON, ORTIZ, PERRY, PHEFFER, SPANO, TOWNS -- read once and referred to the Committee on Corporations, Authorities and Commissions AN ACT to amend the public authorities law, in relation to reimbursing Medicare Part B premium payments made by retirees of the metropolitan transportation authority and its subsidiary corporations THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The public authorities law is amended by adding a new 2 section 1266-j to read as follows: 3 S 1266-J. HEALTH INSURANCE COVERAGE FOR EMPLOYEES OF THE AUTHORITY OR 4 OF ANY OF ITS SUBSIDIARIES, PERSONS RETIRED FROM SUCH EMPLOYMENT, AND 5 DEPENDENTS OF SUCH EMPLOYEES AND RETIREES. 1. AS USED IN THIS SECTION, 6 THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS: 7 (A) "MTA EMPLOYEE" SHALL MEAN A PERSON WHO IS EMPLOYED BY THE AUTHORI- 8 TY OR ANY OF ITS PUBLIC BENEFIT SUBSIDIARY CORPORATIONS. 9 (B) "MTA RETIREE" SHALL MEAN A PERSON WHO: 10 (1) IS RECEIVING A RETIREMENT ALLOWANCE, PENSION OR OTHER RETIREMENT 11 BENEFIT FROM A RETIREMENT OR PENSION SYSTEM TO WHICH THE AUTHORITY OR 12 ONE OF ITS PUBLIC BENEFIT CORPORATION SUBSIDIARIES HAS MADE CONTRIB- 13 UTIONS ON BEHALF OF SUCH PERSON; 14 (2) IMMEDIATELY PRIOR TO SUCH PERSON'S RETIREMENT AS A MEMBER OF SUCH 15 SYSTEM WAS AN MTA EMPLOYEE; AND 16 (3) HAD AT THE TIME OF RETIREMENT AT LEAST FIVE YEARS OF CREDITED 17 SERVICE AS A MEMBER OF SUCH RETIREMENT OR PENSION SYSTEM, EXCEPT THAT 18 SUCH REQUIREMENT OF CREDITED SERVICE SHALL NOT APPLY IN CASES OF RETIRE- 19 MENT FOR ACCIDENT DISABILITY. 20 (C) "DEPENDENT" SHALL MEAN (1) THE SPOUSE OF AN MTA EMPLOYEE OR MTA 21 RETIREE OR (2) ANY CHILD OF ANY MTA EMPLOYEE OR MTA RETIREE DURING THE 22 PERIOD OF ELIGIBILITY OF SUCH CHILD FOR MEDICARE COVERAGE AS A DEPENDENT 23 UNDER TITLE XVIII OF THE FEDERAL SOCIAL SECURITY ACT; PROVIDED, HOWEVER, EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD05473-01-1 A. 6371 2 1 THAT NO SPOUSE OR CHILD OF ANY SUCH EMPLOYEE OR RETIREE SHALL BE DEEMED 2 A DEPENDENT AFTER THE DEATH OF SUCH EMPLOYEE OR RETIREE. 3 2. THE AUTHORITY SHALL REIMBURSE EACH MTA RETIREE THE COST OF THE 4 PREMIUM FOR SUCH RETIREE'S ENROLLMENT IN THE HOSPITAL AND MEDICAL 5 PROGRAM FOR THE AGED AND DISABILITY FOR HIMSELF OR HERSELF AND HIS OR 6 HER DEPENDENTS, UNDER SECTION 1839 (A) OF THE FEDERAL SOCIAL SECURITY 7 ACT. SUCH REIMBURSEMENT SHALL BE MADE ON A MONTHLY BASIS. 8 S 2. This act shall take effect immediately.
