WALCZYK -- read once and referred to the Committee on Corpo- rations, Authorities and Commissions AN ACT to amend the public authorities law, in relation to adding two trustees to the power authority to represent Niagara county and St. Lawrence county The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 1003 of the public authorities law, as amended by 2 chapter 766 of the laws of 2005, is amended to read as follows: 3 § 1003. Trustees. The authority shall consist of [seven] nine trus- 4 tees, five of whom shall serve respectively for terms of one, two, 5 three, four and five years, to be appointed by the governor, by and with 6 the advice and consent of the senate. The sixth and seventh trustees 7 shall be appointed by the governor, by and with the advice and consent 8 of the senate, and shall serve initial terms of one and two years 9 respectively. The eighth and ninth trustees shall be appointed by the 10 governor, by and with the advice and consent of the senate, and shall 11 serve initial terms of one and two years respectively and shall be resi- 12 dents of Niagara county and St. Lawrence county, respectively. Each 13 trustee shall hold office until a successor has been appointed and qual- 14 ified. At the expiration of the term of each trustee and of each 15 succeeding trustee the governor shall, by and with the advice and 16 consent of the senate, appoint a successor, who shall hold office for a 17 term of five years, or until a successor has been appointed and quali- 18 fied. In the event of a vacancy occurring in the office of the trustee 19 by death, resignation or otherwise, the governor shall, by and with the EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD08783-01-9S. 4461 2 A. 6562 1 advice and consent of the senate, appoint a successor, who shall hold 2 office for the unexpired term. Four trustees shall constitute a quorum 3 for the purpose of organizing the authority and conducting the business 4 thereof. 5 The trustee chosen as [chairman] chairperson as provided in section 6 one thousand four of this title, shall receive an annual salary which 7 shall be set by the trustees of the authority, and which shall not 8 exceed the salary prescribed for the positions listed in paragraph (f) 9 of subdivision one of section one hundred sixty-nine of the executive 10 law. Each other trustee shall not receive a salary or other compen- 11 sation. Each trustee shall receive his or her reasonable expenses in the 12 performance of his or her duties hereunder. The trustee chosen as 13 [chairman] chairperson may elect to become a member of the New York 14 state and local employees' retirement system on the basis of such 15 compensation to which he or she shall be entitled as herein provided 16 notwithstanding the provisions of any general, special or local law, 17 municipal charter, or ordinance. 18 § 2. This act shall take effect immediately.
