GLICK, PHEFFER, ROBINSON -- read once and referred to the Committee on Transportation AN ACT to amend chapter 384 of the laws of 2007 relating to establishing the New York city traffic congestion mitigation commission and requir- ing the development of a traffic congestion mitigation plan by the mayor of the city of New York, in relation to requiring the prepara- tion of an environmental impact statement for recommendations made by the New York city traffic congestion mitigation commission THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Section 4 of chapter 384 of the laws of 2007 relating to 2 establishing the New York city traffic congestion mitigation commission 3 and requiring the development of a traffic congestion mitigation plan by 4 the mayor of the city of New York, is amended to read as follows: 5 S 4. As part of its mandate, the commission shall conduct hearings, 6 take testimony and review information and proposals regarding traffic 7 congestion in the city of New York. In addition, the commission shall 8 issue to the governor, the state legislature, the mayor of the city of 9 New York and the New York city council recommendations with respect to 10 the details of implementing the traffic congestion mitigation plan 11 submitted by the mayor and other traffic congestion mitigation proposals 12 (the "implementation plan"). The implementation plan must provide for at 13 least the same level of traffic mitigation, as measured by the 6.3 14 percent reduction in average vehicle miles traveled, as proposed in the 15 traffic mitigation plan submitted to the United States department of 16 transportation for the Urban Partnership Agreement on June 22, 2007. 17 FOR EACH RECOMMENDATION MADE BY THE COMMISSION IN THE IMPLEMENTATION 18 PLAN, AN ENVIRONMENTAL IMPACT STATEMENT SHALL BE PREPARED PURSUANT TO 19 ARTICLE 8 OF THE ENVIRONMENTAL CONSERVATION LAW. SUCH ENVIRONMENTAL 20 IMPACT STATEMENT SHALL BE PREPARED JOINTLY BY THE NEW YORK CITY DEPART- EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. This act shall take effect immediately; provided, however, that 5 the amendments made to section 4 of chapter 384 of the laws of 2007 by 6 section one of this act shall not affect the repeal of such chapter and 7 shall be deemed repealed therewith.
