McDO- NALD -- read once and referred to the Committee on Ways and Means AN ACT to amend the tax law, in relation to the tourist home, inn, hotel or motel tax in Saratoga county and the city of Saratoga Springs THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Subdivision 9 of section 1202-g of the tax law, as amended 2 by chapter 24 of the laws of 2003, is amended to read as follows: 3 (9) Revenues resulting from the imposition of tax authorized by this 4 section shall be paid into the treasury of the county of Saratoga and 5 shall be credited to and deposited in the general fund of the county; 6 the net collections therefrom shall thereafter be allocated by the board 7 of supervisors of Saratoga county [only] FIFTY PERCENT for the promotion 8 of tourism and conventions AND FIFTY PERCENT TO THE SARATOGA COUNTY 9 PROSPERITY PARTNERSHIP, INC. FOR THE PROMOTION OF TOURISM AND OTHER 10 ECONOMIC DEVELOPMENT-RELATED PURPOSES provided, however, that the net 11 collections pursuant to subdivision one-a of this section shall be paid 12 to the general fund of the city of Saratoga Springs, the net collections 13 pursuant to subdivision one-b of this section shall be paid to the city 14 of Saratoga Springs convention and tourism bureau for use in marketing 15 the city of Saratoga Springs as a destination for conventions and group 16 tours and the net collections pursuant to subdivision one-c of this 17 section shall be placed in an interest bearing capital reserve account 18 to fund the expansion and renovation of the City Center until such time 19 as the expansion and renovation has been completed, and thereafter shall 20 be placed in a special account which may be drawn upon to offset any 21 operating deficit maintained by the City Center. A committee of nine 22 persons TO ADVISE THE BOARD ON EXPENDITURES MADE BY THE COUNTY FOR THE 23 PROMOTION OF TOURISM AND CONVENTIONS shall be appointed by such board of 24 supervisors, four of whom shall be members of such body WHO SHALL 25 INCLUDE THE CHAIR OF THE BOARD OF SUPERVISORS, THE CHAIR OF THE BOARD'S EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD09931-01-5 A. 6909 2 1 ECONOMIC DEVELOPMENT COMMITTEE, THE CHAIR OF THE BOARD'S LAW AND FINANCE 2 COMMITTEE, AND ONE MEMBER OF THE BOARD OF SUPERVISORS WHO ALSO SERVES AS 3 A DIRECTOR OF THE SARATOGA COUNTY PROSPERITY PARTNERSHIP, INC. and five 4 [of whom shall be owners, managers or, if such facility be owned by a 5 corporation or partnership, partners or officers of facilities paying 6 such tax, pursuant to the local laws authorized hereunder to advise and 7 recommend to said board of supervisors relative to the purpose of this 8 section] ADDITIONAL MEMBERS WHO SHALL INCLUDE A REPRESENTATIVE FROM THE 9 SARATOGA COUNTY CHAMBER OF COMMERCE, A REPRESENTATIVE FROM THE CHAMBER 10 OF SOUTHERN SARATOGA COUNTY, A REPRESENTATIVE FROM THE SARATOGA CONVEN- 11 TION AND TOURISM BUREAU, A REPRESENTATIVE FROM THE SARATOGA SPRINGS CITY 12 CENTER AUTHORITY AND THE SARATOGA COUNTY TREASURER. 13 S 2. This act shall take effect on the ninetieth day after it shall 14 have become a law.
