       AN ACT to amend the public authorities law, in relation to  procurements
         by  the New York city transit authority and the metropolitan transpor-
         tation authority
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Subdivision  6  of section 1209 of the public authorities
    2  law, as amended by chapter 98 of the laws of 2011, is amended to read as
    3  follows:
    4    6. The provisions of subdivisions one, two, three  and  four  of  this
    5  section  shall  not  be  applicable  to any procurement by the authority
    6  commenced during the period from the effective date of this  subdivision
    7  until  December  thirty-first, nineteen hundred ninety-one or during the
    8  period from December sixteenth, nineteen hundred ninety-three until June
    9  thirtieth, two thousand [fifteen] NINETEEN; and the provisions of subdi-
   10  visions seven, eight, nine, ten, eleven, twelve  and  thirteen  of  this
   11  section  shall  only  apply  to  procurements by the authority commenced
   12  during such periods. The provisions of such subdivisions one, two, three
   13  and four shall apply to procurements by the authority  commenced  during
   14  the period from December thirty-first, nineteen hundred ninety-one until
   15  December  sixteenth,  nineteen hundred ninety-three, and to procurements
   16  by the authority  commenced  on  and  after  July  first,  two  thousand
   17  [fifteen]  NINETEEN.  Notwithstanding  the  foregoing, the provisions of
   18  such subdivisions one, two, three and four shall apply to (i) the  award
   19  of  any contract of the authority if the bid documents for such contract
   20  so provide and such bid documents are issued within sixty  days  of  the
   21  effective  date  of  this  subdivision  or within sixty days of December
   22  sixteenth, nineteen hundred ninety-three, or (ii) for a  period  of  one
   23  hundred eighty days after the effective date of this subdivision, or for
   24  a  period  of one hundred eighty days after December sixteenth, nineteen

    1  hundred ninety-three, the award of any contract for which an  invitation
    2  to  bid, solicitation, request for proposal, or any similar document has
    3  been issued by the authority prior to the effective date of this  subdi-
    4  vision  or  during the period from January first, nineteen hundred nine-
    5  ty-two until December fifteenth, nineteen hundred ninety-three.
    6    S 2. Subdivision 1 of section 1265-a of the public authorities law, as
    7  amended by chapter 98 of the  laws  of  2011,  is  amended  to  read  as
    8  follows:
    9    1.  The provisions of this section shall only apply to procurements by
   10  the authority commenced during the period  from  April  first,  nineteen
   11  hundred eighty-seven until December thirty-first, nineteen hundred nine-
   12  ty-one,  and during the period from December sixteenth, nineteen hundred
   13  ninety-three until June  thirtieth,  two  thousand  [fifteen]  NINETEEN;
   14  provided,  however,  that the provisions of this section shall not apply
   15  to (i) the award of any contract of the authority if the  bid  documents
   16  for  such  contract  so provide and such bid documents are issued within
   17  sixty days of the effective date of this section or within sixty days of
   18  December sixteenth, nineteen hundred ninety-three, or (ii) for a  period
   19  of  one  hundred eighty days after the effective date of this section or
   20  for a period of one hundred eighty days after December sixteenth,  nine-
   21  teen  hundred ninety-three, the award of any contract for which an invi-
   22  tation to bid, solicitation, request for proposal, or any similar  docu-
   23  ment  has  been  issued  by the authority prior to the effective date of
   24  this section or during the period from January first,  nineteen  hundred
   25  ninety-two until December sixteenth, nineteen hundred ninety-three.
   26    S 3. This act shall take effect immediately.
