          SCHIMMINGER -- read once and  referred  to  the  Committee  on  Corpo-
          rations,  Authorities  and  Commissions  -- committee discharged, bill
          amended, ordered reprinted as amended and recommitted to said  commit-
          tee

        AN  ACT  to amend chapter 5 of the laws of 1997 relating to the creation
          of the Roswell Park Cancer Institute corporation and providing for the
          rights, powers,  duties  and  jurisdiction  of  such  corporation,  in
          relation to procurement contracts awarded by the institute

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Section 15 of chapter 5 of the laws of  1997,  relating  to
     2  the  creation  of  the  Roswell  Park  Cancer  Institute corporation and
     3  providing for the rights, powers, duties and jurisdiction of such corpo-
     4  ration, is amended to read as follows:
     5    § 15. Notwithstanding any inconsistent provision of subdivision  2  of
     6  section  2879  of  the  public  authorities law, for the purposes of the
     7  application of such section to the Roswell Park Cancer Institute  corpo-
     8  ration  created  pursuant  to  section  two  of  this  act,  procurement
     9  contracts shall mean any written agreement for the acquisition of  goods
    10  or  services  of  any kind, in the actual or estimated amount of twenty-
    11  five  thousand  dollars  or  more.  [Notwithstanding  any   inconsistent
    12  provisions  of  article 4-C of the economic development law, procurement
    13  contracts awarded by  the  Roswell  Park  Cancer  Institute  corporation
    14  created  pursuant  to  section  two  of this act, in an amount less than
    15  twenty-five thousand dollars shall not be subject to the  provisions  of
    16  such article.]
    17    § 2. This act shall take effect immediately.
