CRUZ, SOLAGES, SILLITTI, JEAN-PIERRE, LAVINE, L. ROSENTHAL, THIELE, K. BROWN -- read once and referred to the Committee on Agriculture -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the agriculture and markets law, in relation to the Nourish New York program The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 1 of section 452 of the agriculture and markets 2 law, as added by chapter 631 of the laws of 2021, is amended to read as 3 follows: 4 1. The commissioner shall, to the extent permitted by state or federal 5 appropriations for such purpose, facilitate programming that ensures 6 surplus agricultural products are provided to food relief organizations 7 at competitive wholesale prices. Notwithstanding sections one hundred 8 twelve and one hundred sixty-three of the state finance law, any monies 9 appropriated for the purposes of this section shall be distributed with- 10 out an application or competitive procurement process to the ten 11 regional food banks. Such funds shall be distributed to each region; 12 provided, in regions with more than one regional food bank, funds shall 13 be distributed equally to food banks within such region. Regional food 14 banks may suballocate funds to food relief organizations. 15 § 2. This act shall take effect immediately.
