       AN ACT to amend the social services law, in relation to  level  two  and
         level three sex offenders
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The social services law is amended by adding a new  section
    2  131-y to read as follows:
    3    S  131-Y.  PLACEMENT  OF  LEVEL  TWO  OR  LEVEL  THREE  SEX OFFENDERS.
    4  NOTWITHSTANDING ANY INCONSISTENT PROVISION OF LAW, NEITHER THE OFFICE OF
    5  CHILDREN AND FAMILY SERVICES, NOR A SOCIAL SERVICES OFFICIAL  ACTING  ON
    6  HIS  OR  HER  OWN  OR  AS  AN  AGENT  PURSUANT  TO  SECTION  ONE HUNDRED
    7  THIRTY-EIGHT-A OF THIS TITLE, SHALL PERMIT OR CAUSE  THE  PLACEMENT  ANY
    8  SEX  OFFENDER  WHO  HAS  BEEN ASSIGNED A LEVEL TWO OR LEVEL THREE DESIG-
    9  NATION PURSUANT TO ARTICLE SIX-C OF THE CORRECTION LAW, INTO ANY  TEMPO-
   10  RARY  EMERGENCY HOUSING OR HOMELESS SHELTERS USED TO HOUSE FAMILIES WITH
   11  CHILDREN.
   12    S 2. This act shall take effect on the thirtieth day  after  it  shall
   13  have become a law.
