STATE OF NEW YORK ________________________________________________________________________ 7821 2019-2020 Regular Sessions IN ASSEMBLY May 23, 2019 ___________ Introduced by M. of A. ZEBROWSKI -- read once and referred to the Committee on Governmental Operations AN ACT authorizing the commissioner of general services to transfer and convey certain unappropriated state land to Rockland Recovery Homes, Inc. The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subject to the provisions of this act but notwithstanding 2 any other provision of law to the contrary, the commissioner of general 3 services is hereby authorized to transfer and convey to Rockland Recov- 4 ery Homes, Inc., in consideration of one dollar and upon such other 5 consideration as the commissioner may deem proper, the state land 6 located at 328 Willow Grove Road, in the Town of Haverstraw, and the 7 County of Rockland, declared to be abandoned state land by the office 8 for people with developmental disabilities. 9 § 2. The lands authorized by section one of this act to be transferred 10 and conveyed are as follows: 11 ALL that piece or parcel of land situate in the Town of Haverstraw, 12 County of Rockland and State of New York being more particularly bounded 13 and described as follows: 14 BEGINNING at a point at the intersection of the southerly bounds of 15 Willow Grove Road with the northerly bounds of a parcel of land conveyed 16 to the Town of Haverstraw by Deed dated July 6, 2001 from New York State 17 Urban Development Corporation and recorded in the Rockland County 18 Clerk's Office as Instrument ID 2001-00033784; thence from said point of 19 beginning along the southerly bounds of Willow Grove Road the following 20 three (3) courses and distances: 21 1. N 74° 05' 11" E, a distance of 284.03 feet to a point; 22 2. N 71° 42' 11" E, a distance of 467.10 feet to a point; and 23 3. N 75° 36' 11" E, a distance of 86.91 feet to a point at the north- 24 east corner of the lands herein described; thence S 14° 07' 40" W, along EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD11756-01-9A. 7821 2 1 the easterly bounds of lands herein described, a distance of 396.34 feet 2 to a point on the northerly bounds of said lands conveyed to the Town of 3 Haverstraw; thence N 78° 53' 35" W, along said lands conveyed to the 4 Town of Haverstraw, a distance of 717.51 feet to the point or place of 5 beginning, containing 3.23 acres of land, be the same, more or less. 6 BEING a portion of lands conveyed to the People of the State of New 7 York by Deed dated September 2, 1909 from Samuel and Tammy Rose and 8 recorded in the Rockland County Clerk's Office in Liber 238 of Deeds at 9 page 611. 10 All as shown and labeled as a 3.23 acre parcel of land on a map enti- 11 tled "Map showing Subdivision Lands N/F, People of the State of New 12 York, known as Letchworth Village" dated June 1999, last revised June 13 18, 2001, prepared by ABD Engineers Surveyors and filed in the New York 14 State Office of General Services as OGS Map No. 1887. 15 § 3. The description in section two of this act of the land to be 16 conveyed is not intended to be a legal description but is intended to 17 identify the parcel to be conveyed. As a condition of the transfer, 18 Rockland Recovery Homes, Inc., may submit to the commissioner of general 19 services, for his or her approval, an accurate survey and description of 20 the lands to be conveyed, which may be used in the conveyance thereof. 21 § 4. The office of general services shall not transfer or convey the 22 aforesaid land unless application is made to the office of general 23 services by Rockland Recovery Homes, Inc. within one year after the 24 effective date of this act. Said application shall be in the form of a 25 resolution setting forth a comprehensive statement approved by its 26 managing board, acknowledging and accepting the use restrictions set 27 forth in section five of this act. 28 § 5. Any lands transferred pursuant to this act shall be used for the 29 purposes of Rockland Recovery Homes, Inc. to utilize the subject proper- 30 ty and improve the structures on the subject property, and upon termi- 31 nation of such use, title to the lands so transferred shall revert to 32 the state of New York. 33 § 6. This act shall take effect immediately.
