       Introduced  by  M.  of  A. DAVILA, O'DONNELL -- (at request of the State
         Commission of Correction) -- read once and referred to  the  Committee
         on Correction
       AN ACT to amend the correction law, in relation to the classification of
         transgender and intersex inmates in county jails
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 500-b of the correction law is amended by adding  a
    2  new subdivision 14 to read as follows:
    3    14.  NOTWITHSTANDING  THE PROVISIONS OF THIS SECTION, A TRANSGENDER OR
    4  INTERSEX INMATE MAY BE ASSIGNED TO ANY FACILITY HOUSING UNIT WHICH, UPON
    5  THE DETERMINATION  OF  THE  CHIEF  ADMINISTRATIVE  OFFICE,  ENSURES  THE
    6  INMATE'S  HEALTH  AND  SAFETY AND IS CONSISTENT WITH FACILITY MANAGEMENT
    7  AND SECURITY.
    8    S 2. This act shall take effect immediately; provided,  however,  that
    9  the  amendments  to  section 500-b of the correction law made by section
   10  one of this act shall not affect the repeal of such section and shall be
   11  deemed repealed therewith.
