STATE OF NEW YORK ________________________________________________________________________ 7867 2023-2024 Regular Sessions IN ASSEMBLY July 7, 2023 ___________ Introduced by M. of A. SIMON -- read once and referred to the Committee on Governmental Operations AN ACT to amend the executive law, in relation to a training course and curriculum on the handling, investigation and response procedures concerning reports of domestic violence The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 837 of the executive law is amended by adding a new 2 subdivision 24 to read as follows: 3 24. (a) (i) The division shall develop and approve a training course 4 and curriculum on the handling, investigation and response procedures 5 concerning reports of domestic violence. This training course and 6 curriculum shall be reviewed at least every two years and modified by 7 the division from time to time as need may require. The division shall 8 distribute the curriculum to all local police agencies. 9 (ii) The attorney general shall be responsible for ensuring that all 10 law enforcement officers attend initial training within ninety days of 11 appointment or transfer and annual inservice training of at least four 12 hours as described in this section. 13 (b) (i) The chief administrator of the courts shall develop and 14 approve a training course and a curriculum on the handling, investi- 15 gation and response procedures concerning allegations of domestic 16 violence. This training course shall be reviewed at least every two 17 years and modified by the chief judge from time to time as need may 18 require. 19 (ii) The chief administrator of the courts shall be responsible for 20 ensuring that all judges and judicial personnel attend initial training 21 within ninety days of appointment or transfer and annual inservice 22 training as described in this section. 23 (iii) The division and the chief administrator of the courts shall 24 provide that all training on the handling of domestic violence matters EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD09757-01-3A. 7867 2 1 shall include information concerning the impact of domestic violence on 2 society, the dynamics of domestic violence, the statutory and case law 3 concerning domestic violence, the necessary elements of a protection 4 order, policies and procedures as promulgated or ordered by the attorney 5 general or the court of appeals, and the use of available community 6 resources, support services, available sanctions and treatment options. 7 Law enforcement agencies shall: (1) establish domestic crisis teams or 8 participate in established domestic crisis teams, and (2) shall train 9 individual officers in methods of dealing with domestic violence. The 10 teams may include social workers, clergy or other persons trained in 11 counseling, crisis intervention or in the treatment of domestic 12 violence. 13 § 2. This act shall take effect on the one hundred eightieth day after 14 it shall have become a law. Effective immediately, the addition, amend- 15 ment and/or repeal of any rule or regulation necessary for the implemen- 16 tation of this act on its effective date are authorized to be made and 17 completed on or before such effective date.
