       AN ACT to amend the education law, in relation  to  the  designation  of
         local government historians
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1.  The education law is amended by adding a new section 229-a
    2  to read as follows:
    3    S 229-A. LOCAL GOVERNMENT HISTORIANS; DESIGNATION. 1. A BOROUGH, COUN-
    4  TY, CITY, TOWN, VILLAGE, OR COMMUNITY HISTORIAN  APPOINTED  PURSUANT  TO
    5  SECTION  57.07  OF THE ARTS AND CULTURAL AFFAIRS LAW WILL BE PLACED ON A
    6  ROSTER OF RECOGNIZED LOCAL GOVERNMENT HISTORIANS. SUCH LIST  WILL  SERVE
    7  AS  A  RESOURCE  FOR  LOCAL AND STATE GOVERNMENTS IN PURVEYING IMPORTANT
    8  INFORMATION PERTAINING TO THE PRESERVATION, PROTECTION AND PROMOTION  OF
    9  NEW  YORK STATE HISTORY. THE LOCAL GOVERNMENT HISTORIAN DESIGNATION LIST
   10  SHALL BE MAINTAINED AND PLACEMENT ON SUCH LIST CONFIRMED  BY  THE  STATE
   11  HISTORIAN AND THE OFFICE OF CULTURAL EDUCATION. IT WILL BE THE RESPONSI-
   12  BILITY   OF THE LOCAL APPOINTING AUTHORITY TO NOTIFY THE STATE HISTORIAN
   13  AND THE OFFICE OF CULTURAL EDUCATION WHEN A LOCAL  GOVERNMENT  HISTORIAN
   14  VACANCY  OCCURS OR WHEN A NEW LOCAL GOVERNMENT HISTORIAN IS APPOINTED TO
   15  SERVE. THE ASSOCIATION OF PUBLIC HISTORIANS   OF NEW  YORK  STATE  SHALL
   16  CONFIRM A LIST OF MEMBERS WHO SHALL QUALIFY TO ASSIST THE STATE HISTORI-
   17  AN  AND  OFFICE  OF  CULTURAL EDUCATION IN CREATING THE LOCAL GOVERNMENT
   18  HISTORIANS DESIGNATION LIST.
   19    2. THE ASSOCIATION OF PUBLIC HISTORIANS OF NEW YORK STATE SHALL ESTAB-
   20  LISH FROM AMONG THEIR MEMBERS A COMMITTEE  WHO  SHALL,  SUBJECT  TO  THE
   21  APPROVAL  OF  THE  STATE HISTORIAN AND THE OFFICE OF CULTURAL EDUCATION,

    1  ESTABLISH PROCEDURES FOR NOTIFYING THE STATE HISTORIAN AND THE OFFICE OF
    2  CULTURAL EDUCATION WHEN A NEW LOCAL GOVERNMENT HISTORIAN  IS  APPOINTED.
    3  THE  NEWLY  APPOINTED LOCAL GOVERNMENT HISTORIAN WILL BE NOTIFIED OF THE
    4  DUTIES  AND  RESPONSIBILITIES OF A LOCAL HISTORIAN AS DEFINED IN SECTION
    5  57.07 OF THE ARTS AND CULTURAL AFFAIRS LAW. THE  ASSOCIATION  OF  PUBLIC
    6  HISTORIANS OF NEW YORK STATE SHALL, AT FIVE YEAR INTERVALS FROM THE DATE
    7  THIS  SECTION  SHALL  HAVE  BECOME  A  LAW, CONDUCT A STUDY OF THE LOCAL
    8  GOVERNMENT HISTORIAN VACANCIES THAT EXIST IN NEW YORK STATE  AND  SUBMIT
    9  THEIR  FINDINGS  AND  RECOMMENDATIONS  REMEDYING  SAID VACANCIES FOR THE
   10  REVIEW AND APPROVAL OF THE STATE HISTORIAN AND THE  OFFICE  OF  CULTURAL
   11  EDUCATION.
   12    S 2. This act shall take effect on the one hundred eightieth day after
   13  it  shall have become a law; provided, however that effective immediate-
   14  ly, the addition, amendment and/or repeal  of  any  rule  or  regulation
   15  necessary  for  the  implementation of this act on its effective date is
   16  authorized and directed to be made  and  completed  on  or  before  such
   17  effective date.
