SIMON, NOLAN -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to directing the commis- sioner of education to issue a guidance memorandum to every school district and board of cooperative educational services to inform them of the unique educational needs of students with dyslexia, dyscalculia and dysgraphia to issue a guidance memorandum to every school district and board of cooperative educational services to inform them of the unique educational needs of students with dyslexia, dyscalculia and dysgraphia The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 305 of the education law is amended by adding a new 2 subdivision 56 to read as follows: 3 56. The commissioner shall issue a guidance memorandum in cooperation 4 with stakeholders and other interested parties, to every school district 5 and board of cooperative educational services to inform them of the 6 unique educational needs of students with dyslexia, dyscalculia and 7 dysgraphia and to clarify that school districts may reference or use the 8 terms dyslexia, dyscalculia, and dysgraphia in evaluations, eligibility 9 determinations, or in developing an individualized education program 10 (IEP) under the Individuals with Disabilities Education Act (IDEA) 11 pursuant to part 300 of title 34 of the code of federal regulations, as 12 such regulations may, from time to time, be amended. 13 § 2. This act shall take effect immediately; provided, however the 14 guidance memorandum required pursuant to section one of this act shall 15 be issued no later than one year after this act shall have become a law.
