       AN  ACT  to  amend the general city law, in relation to the reporting of
         energy consumption and production
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  The  general  city law is amended by adding a new section
    2  18-e to read as follows:
    3    S 18-E. REPORTING OF ENERGY CONSUMPTION AND PRODUCTION IN CITY BUDGET.
    4  1. THE MAYOR OR OTHER  OFFICER  CHARGED  WITH  THE  PREPARATION  OF  THE
    5  PRELIMINARY OR TENTATIVE BUDGET SHALL ANNUALLY INCLUDE A REPORT ON ENER-
    6  GY  CONSUMPTION AND EXPENSES FOR THE FOUR PREVIOUS FISCAL YEARS, PROJEC-
    7  TIONS FOR THE UPCOMING FISCAL YEAR, AND THE PROJECTIONS FOR  THE  SUBSE-
    8  QUENT  FOUR FISCAL YEARS. THE REPORT SHALL INCLUDE FOR EACH FISCAL YEAR,
    9  BUT NOT BE LIMITED TO, THE FOLLOWING INFORMATION:
   10    A. THE TOTAL NUMBER OF CITY-OWNED BUILDINGS  AND  FACILITIES  AND  THE
   11  TOTAL SQUARE FOOTAGE FOR SUCH BUILDINGS AND FACILITIES;
   12    B.  THE  TOTAL ANNUAL ENERGY CONSUMPTION, LISTED BY ENERGY SOURCE, FOR
   13  ALL CITY-OWNED BUILDINGS AND FACILITIES;
   14    C. THE TOTAL ANNUAL ENERGY COST CALCULATED PER SQUARE FOOT, AND LISTED
   15  BY ENERGY SOURCE, FOR ALL CITY-OWNED BUILDINGS AND FACILITIES;
        EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

    1    D. THE TOTAL ANNUAL COST FOR FUEL USED BY CITY-OWNED VEHICLES,  LISTED
    2  BY  FUEL  TYPE AND THE AVERAGE MILEAGE EFFICIENCY OF CITY-OWNED VEHICLES
    3  BY VEHICLE CLASS;
    4    E.  TO  THE GREATEST EXTENT POSSIBLE, A BREAKDOWN BY PERCENTAGE OF THE
    5  TOTAL RENEWABLE ENERGY USED BY ALL CITY-OWNED BUILDINGS AND FACILITIES;
    6    F. TOTAL CITYWIDE INVESTMENTS IN THE PRODUCTION OF ENERGY, BOTH  USING
    7  FOSSIL  FUELS  AND NON-FOSSIL FUELS, EXCLUDING GENERATORS USED FOR EMER-
    8  GENCY PURPOSES; AND
    9    G. TOTAL CITYWIDE EXPENDITURES ON ENERGY CONSERVATION  AND  EFFICIENCY
   10  EFFORTS.
   11    2.  FOR  THE  PURPOSE  OF  THIS SECTION RENEWABLE ENERGY IS DEFINED AS
   12  ENERGY PRODUCED FROM THE FOLLOWING SOURCES: SOLAR  THERMAL,  PHOTOVOLTA-
   13  ICS,  WIND, HYDROELECTRIC, GEOTHERMAL ELECTRIC, GEOTHERMAL GROUND SOURCE
   14  HEAT, TIDAL ENERGY, WAVE ENERGY, OCEAN THERMAL, AND FUEL CELLS.
   15    3. COMMENCING JULY FIRST, TWO THOUSAND TEN,  THE  PROVISIONS  OF  THIS
   16  SECTION  SHALL  APPLY  TO CITIES WITH A POPULATION OF THIRTY THOUSAND OR
   17  MORE ACCORDING TO THE TWO THOUSAND FEDERAL DECENNIAL CENSUS. UPON PUBLI-
   18  CATION OF THE TWO THOUSAND TEN FEDERAL DECENNIAL CENSUS, THE  PROVISIONS
   19  OF  THIS  SECTION SHALL APPLY ONLY TO CITIES WITH A POPULATION OF THIRTY
   20  THOUSAND OR MORE ACCORDING TO SUCH CENSUS. ANY CITY WITH A POPULATION OF
   21  THIRTY THOUSAND OR MORE ACCORDING TO THE TWO THOUSAND TEN FEDERAL DICEN-
   22  NIAL CENSUS WHICH HAD A POPULATION OF LESS THAN THIRTY THOUSAND  ACCORD-
   23  ING  TO  THE TWO THOUSAND FEDERAL DECENNIAL CENSUS SHALL COMPLY WITH THE
   24  PROVISIONS OF THIS SECTION WITHIN SIX MONTHS OF THE PUBLICATION  OF  THE
   25  TWO THOUSAND TEN FEDERAL DECENNIAL CENSUS.
   26    S 2. This act shall take effect immediately.
