WOZNIAK -- read once and referred to the Commit- tee on Health AN ACT to amend the public health law,in relation to requiring forty- eight hour admittance at a hospital for persons treated for overdose of a controlled substance THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The public health law is amended by adding a new section 2 2805-y to read as follows: 3 S 2805-Y. MANDATORY HOSPITAL ADMITTANCE PERIOD FOR OVERDOSE TREATMENT. 4 ANY PERSON TREATED IN A HOSPITAL, AS DEFINED BY SUBDIVISION ONE OF 5 SECTION TWENTY-EIGHT HUNDRED ONE OF THIS ARTICLE, FOR HAVING OVERDOSED 6 ON A CONTROLLED SUBSTANCE, AS DEFINED BY SUBDIVISION FIVE OF SECTION 7 THIRTY-THREE HUNDRED TWO OF THIS CHAPTER, SHALL BE REQUIRED TO BE ADMIT- 8 TED TO SUCH FACILITY FOR AT LEAST A FORTY-EIGHT HOUR PERIOD PRIOR TO 9 RELEASE. A HEALTH CARE PRACTITIONER SHALL INFORM SUCH PERSON, PRIOR TO 10 THEIR RELEASE, OF THE RISKS OF OVERDOSE AND STRATEGIES TO AVOID FUTURE 11 INSTANCES OF OVERDOSE. 12 S 2.
