       AN ACT to amend the parks, recreation and historic preservation law  and
         the  state  finance law, in relation to establishing an administrative
         fund for the Niagara River Greenways Commission
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 39.09 of the parks, recreation and historic preser-
    2  vation  law  is  amended  by  adding  a  new  subdivision 9-a to read as
    3  follows:
    4    9-A. TO EXPEND THE FUNDS DEPOSITED INTO  THE  NIAGARA  RIVER  GREENWAY
    5  COMMISSION ADMINISTRATIVE FUND ESTABLISHED IN SUBDIVISION (K) OF SECTION
    6  EIGHTY-THREE OF THE STATE FINANCE LAW FOR THE PURPOSES SPECIFIED IN THIS
    7  SECTION;
    8    S  2.  Section  83 of the state finance law is amended by adding a new
    9  subdivision (k) to read as follows:
   10    (K) THERE IS HEREBY CREATED A SPECIAL ACCOUNT WITHIN THE  CONSERVATION
   11  FUND TO BE KNOWN AS THE NIAGARA RIVER GREENWAY COMMISSION ADMINISTRATIVE
   12  FUND.  THE  SUM OF ONE HUNDRED SEVENTY-FIVE THOUSAND DOLLARS ($175,000),
   13  OR SO MUCH THEREOF AS MAY BE NECESSARY OUT OF ALL  MONEYS,  REVENUE  AND
   14  INTEREST  THEREON  RECEIVED  AS  A  RESULT OF LICENSING FEES PAID BY THE
   15  PUBLIC FOR USE OF LANDS WITHIN  THE  BOUNDARIES  OF  THE  NIAGARA  RIVER
   16  GREENWAY SHALL BE DEPOSITED INTO THE FUND ANNUALLY, TOGETHER WITH APPLI-
   17  CABLE  ANNUAL COST OF LIVING INCREASES. ALL OF SUCH MONEYS, REVENUES AND
   18  INTEREST SHALL BE AVAILABLE TO THE NIAGARA  RIVER  GREENWAY  COMMISSION,
   19  PURSUANT  TO  APPROPRIATION,  EXCLUSIVELY FOR ADMINISTRATIVE EXPENSES OF
   20  THE NIAGARA RIVER GREENWAY COMMISSION PURSUANT TO SECTION 39.09  OF  THE
   21  PARKS, RECREATION AND HISTORIC PRESERVATION LAW AND SHALL BE PAID OUT ON
   22  THE  AUDIT  AND  WARRANT  OF  THE  COMPTROLLER  ON VOUCHERS CERTIFIED OR
   23  APPROVED BY THE CHAIR OF THE NIAGARA RIVER GREENWAY COMMISSION, OR BY AN
   24  OFFICER OR EMPLOYEE OF THE NIAGARA RIVER GREENWAY COMMISSION  DESIGNATED
   25  BY SUCH CHAIR.
   26    S 3. This act shall take effect immediately.
