Section 1596-c of the public authorities law, as added by 2 chapter 673 of the laws of 1964, is amended to read as follows: 3 S 1596-c. City of Yonkers parking authority. A board to be known as 4 "City of Yonkers parking authority" is hereby created. Such board shall 5 be a body corporate and politic, constituting a public benefit corpo- 6 ration, and its existence shall commence upon the appointment of the 7 members as [herein] provided IN THIS SECTION. It shall consist of a 8 chairman, appointed by the mayor of the city of Yonkers, and [four] 9 EIGHT other members, who shall also be appointed by the mayor. The 10 [appointment of the] chairman shall [be] SERVE for a term of five years 11 [and of each of the other members for terms of one, two, three and four 12 years from the first day of April, nineteen hundred sixty-four. At the 13 expiration of such terms, the terms of office of their successors shall 14 be five years so that the term of office of one-fifth of such members 15 shall expire on the thirty-first day of March in each year]; PROVIDED, 16 HOWEVER, OF THE FOUR OFFICES OF MEMBERS ESTABLISHED PURSUANT TO THE 17 CHAPTER OF THE LAWS OF TWO THOUSAND TWELVE THAT AMENDED THIS SECTION, 18 ONE MEMBER SHALL BE APPOINTED FOR A TERM TO COMMENCE ON THE DAY OF HIS 19 OR HER APPOINTMENT BY THE MAYOR AND WHICH SHALL EXPIRE ON THE 20 THIRTY-FIRST DAY OF MARCH, TWO THOUSAND THIRTEEN; ONE MEMBER SHALL BE 21 APPOINTED FOR A TERM TO COMMENCE ON THE DAY OF HIS OR HER APPOINTMENT BY 22 THE MAYOR AND WHICH SHALL EXPIRE ON THE THIRTY-FIRST DAY OF MARCH TWO EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD13817-12-2 A. 9414--C 2 1 THOUSAND FOURTEEN; ONE MEMBER SHALL BE APPOINTED FOR A TERM TO COMMENCE 2 ON THE DAY OF HIS OR HER APPOINTMENT BY THE MAYOR AND WHICH SHALL EXPIRE 3 ON THE THIRTY-FIRST DAY OF MARCH, TWO THOUSAND FIFTEEN, AND ONE MEMBER 4 SHALL BE APPOINTED FOR A TERM TO COMMENCE ON THE DAY OF HIS OR HER 5 APPOINTMENT BY THE MAYOR AND WHICH SHALL EXPIRE ON THE THIRTY-FIRST DAY 6 OF MARCH, TWO THOUSAND SIXTEEN AND THEIR SUCCESSORS SHALL THEREAFTER BE 7 APPOINTED TO TERMS OF FIVE YEARS. Each member shall continue to serve 8 until the appointment and qualification of his OR HER successor. Vacan- 9 cies in such board occurring otherwise than by the expiration of such 10 term, shall be filled for the unexpired term. NOTHING IN THIS SECTION 11 SHALL PRECLUDE CURRENT MEMBERS, AS OF JUNE FIRST, TWO THOUSAND TWELVE, 12 FROM SERVING OUT THE REMAINDER OF THEIR TERM. The members of the board 13 shall choose from their number a vice-chairman. The mayor may remove any 14 member of the board for inefficiency, neglect of duty or misconduct in 15 office, giving him OR HER a copy of the charges against him OR HER and 16 an opportunity of being heard in person, or by counsel, in his OR HER 17 defense upon not less than ten days' notice. The members of the board 18 shall be entitled to no compensation for their services but shall be 19 entitled to reimbursement for their actual and necessary expenses 20 incurred in the performance of their official duties. The powers of the 21 authority shall be vested in and exercised by a majority of the members 22 of the board then in office. Such board may delegate to one or more of 23 its members or to its officers, agents and employees such powers and 24 duties as it may deem proper. Such board and its corporate existence 25 shall continue only to the thirty-first day of December, nineteen 26 hundred ninety-nine, and thereafter until all its liabilities have been 27 met and its bonds have been paid in full or such liabilities or bonds 28 have otherwise been discharged. Upon its ceasing to exist, all its 29 rights and properties shall pass to the city. 30 S 2. This act shall take effect immediately.
