STATE OF NEW YORK ________________________________________________________________________ 9941 IN ASSEMBLY February 27, 2020 ___________ Introduced by M. of A. O'DONNELL -- read once and referred to the Committee on Governmental Employees AN ACT to amend the civil service law, in relation to allowing a leave of absence to employees for human immunodeficiency virus screening The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The section heading and subdivision 1 of section 159-b of 2 the civil service law, as amended by chapter 465 of the laws of 2017, 3 are amended to read as follows: 4 Excused leave to undertake a screening for cancer or the human immuno- 5 deficiency virus. 1. Every public officer, employee of this state, 6 employee of any county, employee of any community college, employee of 7 any public authority, employee of any public benefit corporation, 8 employee of any board of cooperative educational services (BOCES), 9 employee of any vocational education and extension board, or a school 10 district enumerated in section one of chapter five hundred sixty-six of 11 the laws of nineteen hundred sixty-seven, employee of any municipality, 12 employee of any school district or any employee of a participating 13 employer in the New York state and local employees' retirement system or 14 any employee of a participating employer in the New York state teachers' 15 retirement system shall be entitled to absent himself or herself and 16 shall be deemed to have a paid leave of absence from his or her duties 17 or service as such public officer or employee of this state, employee of 18 any county, employee of any community college, employee of any public 19 authority, employee of any public benefit corporation, employee of any 20 board of cooperative educational services (BOCES), employee of any voca- 21 tional education and extension board, or a school district enumerated in 22 section one of chapter five hundred sixty-six of the laws of nineteen 23 hundred sixty-seven, employee of any municipality, employee of any 24 school district, or any employee of a participating employer in the New 25 York state and local employees' retirement system or any employee of a 26 participating employer in the New York state teachers' retirement system 27 for a sufficient period of time, not to exceed four hours on an annual EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted.
