STATE OF NEW YORK ________________________________________________________________________ 10192--A IN ASSEMBLY March 22, 2018 ___________ Introduced by M. of A. GLICK -- read once and referred to the Committee on Tourism, Parks, Arts and Sports Development -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the Hudson river park act, in relation to permitting the construction of an art installation within the boundaries of pier 52 The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 3 of section 8 of chapter 592 of the laws of 2 1998, constituting the Hudson river park act, is amended by adding a new 3 paragraph (f) to read as follows: 4 (f) Notwithstanding the provisions of this subdivision or section 5 382-a of chapter 190 of the laws of 1990, a significant proposed action 6 identified as an art installation proposed to the Whitney museum by 7 David Hammons and entitled Day's End, consisting of a life-size skeletal 8 replica of the pier 52 shed that is approximately 52 feet tall, 325 feet 9 long and 65 feet wide (following the general outline, dimension, and 10 location of the original pier shed), may be constructed, donated to the 11 trust, maintained and repaired by the Whitney museum within the historic 12 footprint of pier 52. Such art installation shall comply with all other 13 applicable federal, state and local laws. The art installation author- 14 ized by this paragraph shall not be materially altered, sold, leased, 15 exchanged, donated, other than the donation authorized by this paragraph 16 from the museum to the trust, subjected to concession agreement, or used 17 for other than its original purpose without the express authority of an 18 act of the legislature. Any agreement related to the installation 19 authorized by this paragraph between the trust and the Whitney museum, 20 or its representative, shall be posted on the Hudson river park website 21 under "NY State Required Reports and Information", for public review for 22 the duration of such agreement and the existence of such installation. 23 § 2.
