STATE OF NEW YORK ________________________________________________________________________ 10285 IN ASSEMBLY April 10, 2018 ___________ Introduced by M. of A. STECK -- read once and referred to the Committee on Transportation AN ACT to amend the public authorities law, in relation to directing the New York state thruway authority to establish a farm EZ pass which grants discounted tolls for certain motor vehicles used by persons engaged in agricultural production The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The public authorities law is amended by adding a new 2 section 378-b to read as follows: 3 § 378-b. Farm EZ pass. 1. The authority shall establish and issue 4 electronic toll collection devices for single unit trucks and trucks 5 having two or more axles which are owned and operated by a person or 6 entity engaged in the production of crops, livestock and livestock 7 products, as defined in subdivision two of section three hundred one of 8 the agriculture and markets law, when such trucks are used exclusively 9 to further the conducting of such production. The use of such electronic 10 toll collection devices shall provide a ten percent discount on the toll 11 otherwise imposed for the use of the thruway system, or any portion 12 thereof, by the truck to which the device is affixed. 13 2. The authority shall promulgate rules and regulations to implement 14 the provisions of this section, including establishing the type of 15 documentation or other proof required to prove that a truck is exclu- 16 sively used to further the conducting of the production of crops, live- 17 stock and livestock products. 18 § 2. This act shall take effect on the one hundred twentieth day after 19 it shall have become a law; provided, however that, effective immediate- 20 ly, any rules and regulations necessary to implement the provisions of 21 this act on its effective date are authorized and directed to be 22 completed on or before such date.
