STATE OF NEW YORK ________________________________________________________________________ 10341 IN ASSEMBLY April 29, 2020 ___________ Introduced by M. of A. PAULIN -- read once and referred to the Committee on Cities AN ACT to amend the public authorities law, in relation to establishing a parking placard review board The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The public authorities law is amended by adding a new arti- 2 cle 12 to read as follows: 3 ARTICLE 12 4 PARKING PLACARD REVIEW BOARD 5 Section 3985. Parking placard review board. 6 § 3985. Parking placard review board. 1. There is hereby created the 7 parking placard review "board", hereinafter referred to as the "board", 8 which shall consist of a chair and fourteen members; three members upon 9 the recommendation of the governor, one of whom shall be the chair of 10 the board and one of whom shall be the commissioner of the New York 11 state department of transportation or his or her designee; three members 12 upon the recommendation of the mayor of the city of New York, one of 13 whom shall be the commissioner of the New York city department of trans- 14 portation or his or her designee and one of whom shall be the chancellor 15 of the New York city department of education or his or her designee; two 16 members upon the recommendation of the temporary president of the 17 senate; two members upon the recommendation of the speaker of the assem- 18 bly, one of whom shall be the chief judge of New York state or his or 19 her designee; one member who shall be the executive director of the port 20 authority of New York and New Jersey or his or her designee; one member 21 who shall be the chairman of the metropolitan transportation authority 22 or his or her designee; one member who shall be the district attorney of 23 the county of New York or his or her designee; and one member who shall 24 be from the office of the assistant director of the federal bureau of 25 investigation New York field office or his or her designee. 26 2. The board shall undertake a review of the impact of parking placard 27 use within the city of New York. The board shall issue a final report 28 and make recommendations related to the impact of parking placards upon EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD15772-02-0A. 10341 2 1 congestion and shall establish criteria for the retention of existing 2 parking placards and the distribution of new parking placards, and shall 3 consider factors including, but not limited to: 4 (a) the impact of parking placards upon congestion; 5 (b) how often parking placards are misused, including illegal parking 6 at bus stops, in loading zones and at unpaid meters; 7 (c) the effectiveness of any measures that have already been imple- 8 mented to address parking placards, including legislation enacted by the 9 city of New York, and how such measures may be improved and expanded 10 upon; 11 (d) the number of parking placard complaints that are received and the 12 response and resolution of such complaints; 13 (e) requiring entities who issue parking placards to implement a ceil- 14 ing on the number of placards issued; 15 (f) eliminating reserved or dedicated parking for individuals with 16 placards; and 17 (g) enforcement of penalties for parking placard misuse by an entity 18 with independence from the individuals it would need to enforce. 19 3. The board shall, within six months of convening, issue a final 20 report and recommendations to the governor, the mayor of the city of New 21 York, the temporary president of the senate, the speaker of the assem- 22 bly, the commissioner of the New York state department of transporta- 23 tion, the commissioner of the New York city department of transporta- 24 tion, the chancellor of the New York city department of education, the 25 executive director of the port authority of New York and New Jersey, the 26 chairman of the metropolitan transportation authority, the district 27 attorney of the county of New York, and the assistant director of the 28 federal bureau of investigation New York field office. 29 4. The city of New York and any state agency, authority or office 30 shall provide any assistance necessary to assist in the completion of 31 the board's work and promptly respond to any requests for information or 32 consultation consistent with the purposes of this section. 33 5. Members of the board shall serve without compensation. 34 § 2. This act shall take effect immediately.
