STATE OF NEW YORK ________________________________________________________________________ 10357 IN ASSEMBLY May 23, 2016 ___________ Introduced by M. of A. SIMOTAS, WEINSTEIN -- read once and referred to the Committee on Judiciary AN ACT to amend the civil practice law and rules, in relation to attor- ney requirements regarding revocable trusts The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision (b) of section 4503 of the civil practice law 2 and rules is amended to read as follows: 3 (b) Wills and revocable trusts. In any action involving the probate, 4 validity or construction of a will or, after the grantor's death, a 5 revocable trust, an attorney or his employee shall be required to 6 disclose information as to the preparation, execution or revocation of 7 any will, revocable trust, or other relevant instrument, but he shall 8 not be allowed to disclose any communication privileged under subdivi- 9 sion (a) which would tend to disgrace the memory of the decedent. 10 § 2.
