STATE OF NEW YORK ________________________________________________________________________ 10614 IN ASSEMBLY June 9, 2020 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Taylor) -- read once and referred to the Committee on Ways and Means AN ACT to amend the executive law, in relation to the law enforcement misconduct investigative office The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 1 of section 75 of the executive law, as added 2 by a chapter of the laws of 2020 amending the executive law, the public 3 authorities law and chapter 154 of the laws of 1921 relating to the port 4 authority of New York and New Jersey relating to establishing the law 5 enforcement misconduct investigative office, as proposed in legislative 6 bill numbers S.3595-C and A.10002-B, is amended to read as follows: 7 1. Jurisdiction. This section shall, subject to the limitations 8 contained in this section, confer upon the law enforcement misconduct 9 investigative office jurisdiction over all covered agencies. For the 10 purposes of this section "covered agency" means [a police] an agency of 11 any political subdivision within the state[, including authorities or12agencies] maintaining a police force or police forces of individuals 13 defined as police officers in section 1.20 of the criminal procedure 14 law, provided however, covered agency does not include any agency, 15 public authority, or other entity under the jurisdiction of the state 16 inspector general pursuant to article four-A of the executive law, the 17 metropolitan transportation authority inspector general pursuant to 18 section one thousand two hundred seventy-nine of the public authorities 19 law, or the port authority inspector general pursuant to chapter one 20 hundred fifty-four of the laws of nineteen twenty-one. [Wherever a21covered agency is a board, commission, a public authority or public22benefit corporation, the head of the agency is the chairperson thereof.] 23 § 2. This act shall take effect on the same date and in the same 24 manner as a chapter of the laws of 2020 amending the executive law, the 25 public authorities law and chapter 154 of the laws of 1921 relating to 26 the port authority of New York and New Jersey relating to establishing 27 the law enforcement misconduct investigative office, as proposed in 28 legislative bill numbers S.3595-C and A.10002-B, takes effect.
