STATE OF NEW YORK ________________________________________________________________________ 10656 IN ASSEMBLY July 22, 2024 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Solages) -- read once and referred to the Committee on Judiciary AN ACT to amend the real property law, in relation to extending the revocation period for real estate brokers and real estate salespersons and to including the license revocation and suspension history of real estate brokers or real estate salespersons on the data.ny.gov website The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 4 of section 441-c of the real property law, as 2 amended by chapter 529 of the laws of 2022, is amended and a new subdi- 3 vision 5 is added to read as follows: 4 4. Whenever the license of a real estate broker or real estate sales- 5 person is revoked by the department, such real estate broker or real 6 estate salesperson shall be ineligible to be relicensed either as a real 7 estate broker or real estate salesperson until after the expiration of a 8 period of [one year] three years from the date of such revocation. 9 5. If the license of a real estate broker or real estate salesperson 10 is suspended or revoked pursuant to the provisions of this section, such 11 suspension or revocation shall be added to the information pertaining to 12 such real estate broker or real estate salesperson set forth in the 13 listing of active real estate salespersons and brokers maintained by the 14 department of state on the online Open Data Website (data.ny.gov) and 15 made available to the public. 16 § 2. This act shall take effect on the first of January next succeed- 17 ing the date upon which it shall have become a law.
