STATE OF NEW YORK ________________________________________________________________________ 10706 IN ASSEMBLY August 28, 2024 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Santabar- bara) -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to requiring operators of motor vehicles to reduce speed when passing an ice cream truck The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision (e) of section 1180 of the vehicle and traffic 2 law, as amended by chapter 293 of the laws of 2016, is amended to read 3 as follows: 4 (e) The driver of every vehicle shall, consistent with the require- 5 ments of subdivision (a) of this section, drive at an appropriate 6 reduced speed when approaching and crossing an intersection or railway 7 grade crossing, when approaching and going around a curve, when 8 approaching a hill crest, when approaching and passing by an emergency 9 situation involving any authorized emergency vehicle which is parked, 10 stopped or standing on a highway and which is displaying one or more red 11 or combination red, white, and/or blue lights pursuant to the provisions 12 of paragraph two and subparagraph b of paragraph four of subdivision 13 forty-one of section three hundred seventy-five of this chapter, when 14 traveling upon any narrow or winding roadway, when approaching and pass- 15 ing by a mobile ice cream vendor vehicle that is parked, stopped or 16 standing on the shoulder or on any portion of the roadway during such 17 vehicle's hours of operation, and when any special hazard exists with 18 respect to pedestrians, or other traffic by reason of weather or highway 19 conditions, including, but not limited to a highway construction or 20 maintenance work area, or when approaching a hazard vehicle which is 21 parked, stopped or standing on the shoulder or on any portion of such 22 highway and such hazard vehicle is displaying one or more amber lights 23 pursuant to the provisions of paragraph three of subdivision forty-one 24 of section three hundred seventy-five of this chapter. 25 § 2.
