STATE OF NEW YORK ________________________________________________________________________ 11099 IN ASSEMBLY June 5, 2018 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Cusick) -- read once and referred to the Committee on Energy AN ACT to amend the public service law, in relation to establishing the energy storage deployment policy The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 74 of the public service law, as amended by a chap- 2 ter of the laws of 2018 amending the public service law and the public 3 authorities law relating to establishing the energy storage deployment 4 policy, as proposed in legislative bills numbers S. 7318-A and A. 5 8921-A, is amended to read as follows: 6 § 74. Energy storage deployment policy. 1. As used in this section 7 "qualified energy storage system" shall mean commercially available 8 technology that is capable of absorbing energy, storing it for a period 9 of time, and thereafter dispatching the energy using mechanical, chemi- 10 cal, or thermal processes to store energy that was generated at one time 11 for use at a later time. 12 2. By December thirty-first, two thousand eighteen, the commission 13 shall, in consultation with the New York state energy research and 14 development authority [and], the Long Island power authority, and the 15 federally designated electric bulk system operator for New York state, 16 after a hearing held on notice, establish by order, rules and regu- 17 lations, both a two thousand thirty energy storage goal for the state 18 and a deployment policy to support that goal. The energy storage deploy- 19 ment policy shall [include the following] assist with and take the 20 following into consideration: 21 (a) avoided or deferred costs associated with transmission, distrib- 22 ution, [or] and/or generation capacity; 23 (b) minimization of peak load in constrained areas; 24 (c) systems that are connected to customer facilities and systems that 25 are directly connected to transmission and distribution facilities; 26 (d) cost-effectiveness; 27 (e) [assisting] the integration of variable-output energy resources; 28 (f) reducing emissions of greenhouse gases; EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD15877-05-8A. 11099 2 1 (g) reducing demand for peak electrical generation; [and] 2 (h) improving the reliable operation of the electrical transmission or 3 distribution systems; and 4 (i) such other issues deemed appropriate by the commission. 5 3. To the extent that the energy storage deployment policy directs the 6 procurement of qualified energy storage systems to encourage their 7 deployment, such procurements shall be awarded through a competitive 8 process. 9 4. Annual reports on the achievements and effectiveness of the policy 10 [to] shall be submitted to the governor, the temporary president of the 11 senate, and the speaker of the assembly[; and12(j) Such other issues deemed appropriate by the commission]. 13 § 2. This act shall take effect on the same date and in the same 14 manner as a chapter of the laws of 2018 amending the public service law 15 and the public authorities law relating to establishing the energy stor- 16 age deployment policy, as proposed in legislative bills numbers S. 17 7318-A and A. 8921-A, takes effect.
