        AN ACT to amend the  environmental  conservation  law,  in  relation  to
          removing  requirements that a parent, guardian or person and the minor
          remain at ground level at all times while deer hunting

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Paragraph  (b) of subdivision 1 of section 11-0935 of the
     2  environmental conservation law, as added by section  1  of  part  ZZ  of
     3  chapter 55 of the laws of 2021, is amended to read as follows:
     4    (b)  such  parent,  guardian or person has had at least three [year's]
     5  years' experience in hunting deer; and
     6    (i) such parent, guardian or person holds a hunting license; and
     7    (ii) such parent, guardian or person maintains physical  control  over
     8  the minor at all times while hunting. For the purposes of this paragraph
     9  "physical  control" shall mean that the physical proximity of such minor
    10  to the parent, guardian or person is such that the parent,  guardian  or
    11  person  is  reasonably able to issue verbal directions and instructions,
    12  maintain constant visual contact, and  otherwise  provide  guidance  and
    13  supervision to the minor; and
    14    [(iii)  such parent, guardian or person and the minor remain at ground
    15  level at all times while hunting; and]
    16    § 2. This act shall take effect immediately; provided,  however,  that
    17  the  amendments made to subdivision 1 of section 11-0935 of the environ-
    18  mental conservation law made by section one of this act shall not affect
    19  the repeal of such section and shall be deemed repealed therewith.
