KENNEDY -- read twice and ordered printed, and when printed to be committed to the Committee on Education -- recommitted to the Committee on Education in accordance with Senate Rule 6, sec. 8 -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the education law, in relation to moving the date of the election of members of the board of education of the Buffalo city school district to the third Tuesday in May The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph p of subdivision 10 of section 2553 of the educa- 2 tion law, as amended by chapter 95 of the laws of 1979, is amended to 3 read as follows: 4 p. The election of members of the board of education of the school 5 district of the city of Buffalo shall take place on the third Tuesday in 6 May [seventh, nineteen hundred seventy-four and on the first Tuesday in7May thereafter] in each year in which an incumbent's term expires; 8 provided, however that such election shall be held on the second Tuesday 9 in May if the commissioner, at the request of the school board, certi- 10 fies no later than March first that such election would conflict with 11 religious observances. Such election shall be conducted by the board of 12 elections of the county of Erie in the same manner as other elections 13 are conducted by it. Polls shall be open for voting for the hours 14 prescribed by section 8-100 of the election law for primary elections. 15 The results of such elections, after canvassing, shall be certified and 16 reported by the board of elections to the board of education of such 17 city. The clerk or other appropriate officer of the board of education 18 shall within twenty-four hours after receipt of such certification by 19 the board of elections serve a written notice either personally or by EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted.
