STATE OF NEW YORK ________________________________________________________________________ 1201 2019-2020 Regular Sessions IN SENATE January 11, 2019 ___________ Introduced by Sen. RITCHIE -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to all terrain vehicles and agricultural use The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 401 of the vehicle and traffic law is amended by 2 adding a new subdivision 14 to read as follows: 3 14. Registration of all terrain vehicles operated upon public highways 4 connecting portions of a farm or farms, fields and agriculture build- 5 ings, and up to one-half mile from the vehicle owner's farm. Notwith- 6 standing any other provision of law to the contrary, all terrain vehi- 7 cles with a weight of no more than one thousand five hundred pounds, to 8 be operated by any person, upon a public highway for the purpose of 9 traveling by the most direct route, but in no event further than one 10 half mile one-way from a point on the vehicle owner's farm between 11 fields, buildings, and facilities managed or operated as part of a 12 single farm enterprise in connection with production, harvesting, proc- 13 essing or marketing on that farm of crops, livestock, or livestock 14 products produced on that farm, may be registered as provided in this 15 subdivision. Every owner of such vehicles may cause to be filed by mail 16 or otherwise, with the commissioner or with any agent of the commission- 17 er, an application for registration of such vehicle, addressed to the 18 commissioner, and on a blank form to be furnished by the commissioner 19 for that purpose, containing the information required by subdivision one 20 of this section and such other information as the commissioner shall 21 require. The commissioner or agent shall make such investigation, as he 22 or she shall determine necessary, and if satisfied that the vehicle is 23 to be operated exclusively as provided in this subdivision shall, upon 24 the payment of a fee of one dollar, assign to such vehicle a distinctive 25 number and issue and deliver to the applicant a set of number plates and EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD05030-01-9S. 1201 2 1 a certificate of registration in such form as the commissioner shall 2 prescribe, indicating the extent to which the vehicle registered may be 3 operated on the public highways and such vehicle may be operated only as 4 so indicated. For the purposes of this subdivision, the terms "farm" and 5 "crops, livestock or livestock products" shall have the same meaning as 6 "land used in agricultural production" and "crops, livestock and live- 7 stock products", respectively, as defined in section three hundred one 8 of the agriculture and markets law, except that farmers with an average 9 gross sales value of at least one thousand dollars per year of crops, 10 livestock, and livestock products shall be eligible to register vehicles 11 pursuant to this subdivision. 12 § 2. This act shall take effect on the ninetieth day after it shall 13 have become a law.
