STATE OF NEW YORK ________________________________________________________________________ 1237 2019-2020 Regular Sessions IN SENATE January 11, 2019 ___________ Introduced by Sens. AMEDORE, AKSHAR -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to requiring the commissioner of health to develop guidelines for the prescribing of opioid antagonists The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The public health law is amended by adding a new section 2 3346 to read as follows: 3 § 3346. Guidelines for the prescribing of opioid antagonists. 1. The 4 commissioner shall adopt guidelines for the prescribing of opioid antag- 5 onists that are applicable to all licensed health care providers in the 6 state who are authorized to prescribe an opioid analgesic. Such guide- 7 lines must address: 8 (a) prescribing an opioid antagonist to a patient to whom an opioid 9 medication is also prescribed; and 10 (b) identifying patients at risk of an opioid-related drug overdose 11 and prescribing an opioid antagonist to that patient or to a person in a 12 position to administer the opioid antagonist to that patient. 13 2. In adopting guidelines under this section, the commissioner shall 14 consult with the state board of pharmacy as well as materials published 15 by, but not limited to, the substance abuse and mental health services 16 administration of the United States department of health and human 17 services and other appropriate materials, including medical journals 18 subject to peer review and publications by medical professional associ- 19 ations. 20 3. The commissioner is authorized to promulgate rules and regulations 21 necessary for the implementation of this section. 22 § 2. This act shall take effect on the one hundred eightieth day after 23 it shall have become a law. Effective immediately, the addition, amend- 24 ment and/or repeal of any rule or regulation necessary for the implemen- 25 tation of this act on its effective date are authorized to be made and 26 completed on or before such date.
