       AN  ACT  to amend the public service law and the public authorities law,
         in relation to requiring that the  public  service  commission  ensure
         equitable  treatment  of all retail customers of electric corporations
         and municipal electric utilities
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1. Subdivision 21 of section 66 of the public service law, as
    2  added by chapter 718 of the laws of 1980, is amended to read as follows:
    3    21. The commission shall require every electric corporation to  submit
    4  storm  plans to the commission for review and approval at such times and
    5  in such detail and form  as  the  commission  shall  require,  provided,
    6  however,  that the same shall be filed at least annually.  TO ENSURE THE
    7  EQUITABLE TREATMENT OF ALL RETAIL CUSTOMERS IN NEW YORK, THE  COMMISSION
    8  SHALL  REQUIRE  THAT  THE  ELECTRIC  CORPORATION'S  STORM  PLAN RESTORES
    9  SERVICE TO RETAIL CUSTOMERS OF ADJACENT ELECTRIC CORPORATIONS AND MUNIC-
   10  IPAL ELECTRIC UTILITIES THAT DEPEND ON THE ELECTRIC CORPORATION'S FACIL-
   11  ITIES FOR ELECTRIC SERVICE ON A BASIS COMPARABLE TO ITS  RETAIL  CUSTOM-
   12  ERS.
   13    S  2.  Section  1020-cc  of  the public authorities law, as amended by
   14  chapter 413 of the laws of 2011, is amended to read as follows:
   15    S 1020-cc. Authority subject to certain provisions  contained  in  the
   16  state  finance  law, the public service law, the social services law and
   17  the general municipal law. All  contracts  of  the  authority  shall  be
   18  subject to the provisions of the state finance law relating to contracts
   19  made  by  the  state. The authority shall also establish rules and regu-
   20  lations with respect to providing to its residential gas,  electric  and
   21  steam utility customers those rights and protections provided in article

    1  two  and  sections one hundred seventeen and one hundred eighteen of the
    2  public service law and section one hundred thirty-one-s  of  the  social
    3  services  law.  The  authority  shall  conform  to  any safety standards
    4  regarding  manual lockable disconnect switches for solar electric gener-
    5  ating equipment established by the public service commission pursuant to
    6  subparagraph (ii) of paragraph (a) of subdivision five and  subparagraph
    7  (ii)  of  paragraph  (a) of subdivision five-a of section sixty-six-j of
    8  the public service law. THE AUTHORITY SHALL SUBMIT STORM PLANS, AT LEAST
    9  ANNUALLY, IN SUCH A MANNER SIMILAR IN DETAIL  AND  FORM  AS  THE  PUBLIC
   10  SERVICE  COMMISSION  REQUIRES  PURSUANT  TO  SUBDIVISION  TWENTY-ONE  OF
   11  SECTION SIXTY-SIX OF THE PUBLIC SERVICE LAW.  The  authority  shall  let
   12  contracts for construction or purchase of supplies, materials, or equip-
   13  ment pursuant to section one hundred three and paragraph (e) of subdivi-
   14  sion four of section one hundred twenty-w of the general municipal law.
   15    S 3. This act shall take effect immediately.
