       Introduced  by Sens. ESPAILLAT, PERKINS -- read twice and ordered print-
         ed, and when printed to be committed to the Committee on Codes
       AN ACT to amend the penal law, in relation to the use  of  coercion  for
         the purpose of exposing a person's immigration status
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 9 of  section  135.60  of  the  penal  law,  as
    2  amended  by chapter 426 of the laws of 2008, is amended and a new subdi-
    3  vision 10 is added to read as follows:
    4    9. Perform any other act which would not in itself materially  benefit
    5  the actor but which is calculated to harm another person materially with
    6  respect  to his or her health, safety, business, calling, career, finan-
    7  cial condition, reputation or personal relationships[.]; OR
    8    10. EXPOSE IMMIGRATION STATUS, REGARDLESS OF THE ACTOR'S KNOWLEDGE  OF
    9  SUCH STATUS.
   10    S  2.  Paragraph  (c)  of subdivision 2 of section 135.65 of the penal
   11  law, as amended by chapter 426 of the laws of 2008, is amended and a new
   12  paragraph (d) is added to read as follows:
   13    (c) Violate his or her duty as a public servant[.]; OR
   14    (D) EXPOSE HIS OR HER OWN IMMIGRATION STATUS.
   15    S 3. This act shall take effect on the first of November next succeed-
   16  ing the date on which it shall have become a law.
