STATE OF NEW YORK ________________________________________________________________________ 1807 2017-2018 Regular Sessions IN SENATE January 11, 2017 ___________ Introduced by Sen. KENNEDY -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to instruction on drug prevention, particularly opioids The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 305 of the education law is amended by adding two 2 new subdivisions 56 and 57 to read as follows: 3 56. a. The commissioner shall make recommendations to the board of 4 regents relating to the adoption of instruction in elementary schools 5 concerning drug prevention, particularly opioids such as heroin, effects 6 of drug use, and addiction treatment services. 7 b. In providing these recommendations to the board of regents, the 8 commissioner shall: 9 (i) seek the recommendations of teachers, school administrators, 10 teacher educators, school psychologists, school social workers and 11 others with educational expertise in the proposed curriculum; 12 (ii) seek comment from parents, students and other interested parties; 13 (iii) seek comment from the state office of alcoholism and substance 14 abuse services; 15 (iv) seek comment from providers of these services, particularly those 16 who provide services for adolescents; 17 (v) consider the fiscal impact, if any, on the state and school 18 districts; 19 (vi) consider the relevance of existing regulations pertaining to drug 20 use as part of the school health curriculum as it relates to the current 21 instruction of alcohol, drugs and tobacco and that relationship to the 22 understanding of mental health as an integral part of health; and 23 (vii) consider any additional factors the commissioner deems relevant. 24 c. No later than sixty days before the following school year after the 25 effective date of this subdivision, the commissioner shall provide a EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD01133-01-7S. 1807 2 1 recommendation to the board of regents to either adopt and promulgate 2 appropriate rules and regulations implementing such curriculum or reject 3 the implementation of such curriculum. Upon receiving a recommendation 4 from the commissioner, pursuant to this subdivision, the board of 5 regents shall vote to either accept or reject the commissioner's recom- 6 mendation no later than thirty days after receiving such recommendation. 7 d. If the board of regents adopts such curriculum, the curriculum 8 requirement shall take effect no later than the next school year after 9 such curriculum has been adopted. 10 e. If the board of regents rejects such curriculum, the commissioner 11 shall provide a report as to the determination of the board to the 12 governor, the temporary president of the senate, the speaker of the 13 assembly and the chairs of the senate and assembly committees on educa- 14 tion providing the reasons for such rejection not later than thirty days 15 after the board of regents rejects such curriculum. 16 57. The commissioner shall on a biennial basis provide school 17 districts with educational information relating to current drug abuse 18 issues in order to ensure instruction provided pursuant to subdivision 19 three of section eight hundred four of this chapter is relevant and 20 current. 21 § 2. This act shall take effect immediately.
