STATE OF NEW YORK ________________________________________________________________________ 2349--A 2023-2024 Regular Sessions IN SENATE January 20, 2023 ___________ Introduced by Sens. MYRIE, LIU -- read twice and ordered printed, and when printed to be committed to the Committee on Elections -- commit- tee discharged, bill amended, ordered reprinted as amended and recom- mitted to said committee AN ACT to amend the election law, in relation to providing that a voter may register to vote at any residence to which the voter maintains a continuous connection with an intent to remain The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 5-104 of the election law is amended by adding a 2 new subdivision 3 to read as follows: 3 3. Nothing in this section shall prevent a voter from registering to 4 vote from any residence to which the voter maintains a continuous 5 connection with an intent to remain, including a second or vacation home 6 or home where a student lives while attending a college or university. 7 § 2. The opening paragraph of subdivision 1 of section 8-400 of the 8 election law, as amended by chapter 63 of the laws of 2010, is amended 9 to read as follows: 10 A qualified voter may vote as an absentee voter under this chapter 11 from a residence at which the voter is registered to vote, including any 12 residence to which the voter maintains a continuous connection with an 13 intent to remain such as a second or vacation home or home where a 14 student lives while attending a college or university, if, on the occur- 15 rence of any village election conducted by the board of elections, 16 primary election, special election, general election or New York city 17 community school board district or city of Buffalo school district 18 election, he or she expects to be: 19 § 3.
