STATE OF NEW YORK ________________________________________________________________________ 2674 2025-2026 Regular Sessions IN SENATE January 22, 2025 ___________ Introduced by Sen. HOYLMAN-SIGAL -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the criminal procedure law, in relation to protective orders for juries The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 1-a of section 270.15 of the criminal procedure 2 law, as amended by a chapter of the laws of 2024 amending the criminal 3 procedure law relating to protective orders for juries, as proposed in 4 legislative bills numbers S. 6239 and A. 7495, is amended to read as 5 follows: 6 1-a. The court may [for], upon a finding that there is good cause 7 [shown] to believe that a threat to the safety or integrity of the jury 8 exists, upon motion of either party or any affected person or upon its 9 own initiative, issue a protective order for a stated period regulating 10 disclosure of the names and the business or residential address of any 11 prospective or sworn juror to any person or persons, other than to coun- 12 sel for either party. In determining whether good cause exists, the 13 court may consider: 14 (a) whether the defendant or persons acting on behalf of the defendant 15 have bribed, tampered with, or caused or attempted to cause physical 16 injury to or harassed a juror or prospective juror in another criminal 17 action or proceeding or in the instant criminal action or proceeding; 18 (b) the seriousness of the charges against the defendant, including 19 whether the defendant is charged with participating in a large-scale 20 criminal enterprise; and 21 (c) the extent of pretrial publicity concerning the criminal action or 22 proceeding. 23 § 2. This act shall take effect on the same date and in the same 24 manner as a chapter of the laws of 2024 amending the criminal procedure 25 law relating to protective orders for juries, as proposed in legislative 26 bills numbers S. 6239 and A. 7495, takes effect.
